So, if I decide to rob someone while causing absolutely no personal harm, then I get caught and only have to pay a fine or restitution and do some community service?

Unless you decide that a fine and restitution is not something you think is fair. Then you can delay, and others will say that the D.A. should have just given you a suspended sentence to avoid costing tax payers money.

Apparently if you do no harm to anyone when you commit a crime, then you shouldn't get in trouble. That's what I get from people who say, "hey they're just trees. Nobody got hurt. Just give him a few hours of community service."

Personally, I think that Harvey should do some time in jail.

But the only published report of a plea offer I have seen was the 13 years reported by ESPN. Some have said that wasn't accurate. I haven't seen any other offer reported. Obviously a 63 year old man isn't going to agree to 13 years. He has nothing to lose by fighting. It seems to me that the prosecution, if they truly want to use their time and taxpayer dollars efficiently while at the same time administering justice, needs to come up with a deal that the defense will accept. And no, that doesn't mean that the defense decides their punishment. It means that you do what is done in courtrooms every day in this country...offer the guy a reasonable deal that he will accept. And if he doesn't accept it, then you go to trial and throw the whole truckload at him and get the maximum sentence.

We don't know this hasn't happened and Harvey is on record saying he would rather die than go to prison.

ETA: I agree that 13 years isn't a deal Harvey should take if indeed that is the offer.

As a normal person and Auburn fan, I would like to see him get something like 6 months jail time and community service (heard his health was bad though), and a fine (the dumbass portion of Bama fans will raise the money for him).

I think this would appease all normal people.

HU is an absolute dumbass. But this trial is a waste. Give him a gazillion hours of community service in Auburn, make him war an Auburn jersey, pay restitution, fine him, and be done with it.

If they can find a jury in State College for Sandusky, they can find a competent Jury in Auburn... His own actions caused this continuance and should not be the reason for moving the trial..

I am sure the judge knows he did not handle the trial very well... He should have issued a gag order immediately and not allowed Updyke to speak while out on probation... No ESPN special, no Fbaum, etc...

13 years? Is that really what the prosecution offered?? I wouldn't take that deal either....over a tree? I think murderers have gotten less than that before.

3-6 months max, if that, is all that he deserves IMO. Some crimes are more severe than others, and this one is pretty small beans. I'm not even convinced he deserves jail time over this prank.

Not that it really matters, because he did what he did, but the trees apparently are going to make it.

This would make me happy. But I have no idea where you're getting such an idea from because I have heard no such thing.
