This precedent needs to be set honestly.
If they are successful.. you might start seeing a slew of lawsuits from collectives across the country.

NIL is not pay for play "technically." I like it though; we need some wrenches thrown into this mess.

The two players situations are likely vastly different.

Madden just arrived on campus, which means his contract just started. Hunter releasing that statement leads me to believe a large portion of the money has already been paid to him. That contract is likely for a year, which means Madden did not fulfill his end of the agreement.

Nico had been at Tennessee for a while and we do not know what part of his contract he was in, or if his had ended and he wanted more money on his new one.

Maddens case seems pretty simple. Just arrived 3 months ago, collected a paycheck, didn’t fulfill obligations, and then bounced.

The courts are going to have to side with schools eventually on these issues. I can't wait for that to happen, and put these players and handlers in their place.

Will not be UA lawyers. It will really depend on where the money came from. Tyson, Walton, Hunt, or Stephens…Hunter didn’t just get pissed and decide to release that statement. Whoever footed that bill for Madden wants their money back.

It needs to be done. Arkansas can't afford to be paying players and don't bother staying around for a full calendar year.

At this point, can we scrap this whole thing and start over with teams of Juco and D2/D3 players who just want to play football?

IDGAF what their 40 time is as long as they have heart and a passion to compete.

It'll depend on the what actual breach is I suppose. I wonder if it has something to do with repaying a signing bonus or if was a duty to notify.

Are some of these collectives paying lump sums? I would expect/hope it’s being paid out in weekly or monthly installments.

To get the athlete on campus, a percentage will have to be up front. Otherwise you don’t get them to campus. See the Florida fiasco a year or so ago with the QB who signed, then didn’t get any money as told.

does anyone know if they can require enrollment at the university full time? I know it cant be pay for play but seems like they could require them to be a full time student in good standing

also could require them to have certain obligations on week nights on purpose just to make it really really difficult to live somewhere else. then require certain number of appearances every Wednesday or even Thursday whatever as the NIL part of the initial sum. Or they could put it at traditional practice time every monday and that said player has to film a 30s video every monday at a the traditional start time of practice.


things like that make it very difficult to not be in breach of contract if you are not living there.

They can't require enrollment I wouldn't think as that gets into is playing a requirement which is supposed to be a no-no, but they could require you live in a certain mile radius of their home office and ask for return of upfront benefits if move out occurs within a certain amount of time.

This ^^^^

Especially when you've got schools that have no problem giving a pro-rated portion of up-front money. I'm sure this over up upfront money for services he never provided.
