NIL collectives need to be controlled by the schools as the school is held responsible for anything the collectives do wrong, so might as well have control so you don't get into trouble for things you currently have zero control over.
Also, NIL needs to be part of the recruiting pitch. No where else do you "interview for a job" but when you ask about salary and benefits are you told "we can't discuss this until after you take the job". NCAA has been feckless for years and has lead us to this.

Players have to disclose their NIL deals to the school they attend.
The school is tasked with making sure those contracts don't have any inducements to attend a school in them. If they do, the school is responsible for suspending the player as long as the contract is in effect.
As far as collective vs broker, the NCAA rules don't view them differently. Both are considered boosters by NCAA bylaws, and thus the school is responsible for any NCAA rules broken by those entities.

The defendant in a law suit can't "tuck it's tail and run".
The state of Tennessee is suing the NCAA, not the other way around. The NCAA is stuck with the trial unless the state of Tennessee bails.
