Assuming we're University-1, it seems like it'd be difficult for AU to be simultaneously serving as a victim for the federal case and be the bad actor for the NCAA

A rogue agent with motivations entirely unrelated to, and contrary to the benefit of, the program/university who employed him. Is there a comparable situation we can look to?
