We are a victim in the sense we were technically defrauded out of paying ineligible players grant and scholarship money which is one aspect that gives the feds jurisdiction. However, as it relates to the ncaa, we can be seen as a bad actor because Person was acting as an agent of our program, even if he was rogue.

A rogue agent with motivations entirely unrelated to, and contrary to the benefit of, the program/university who employed him. Is there a comparable situation we can look to?
