A rogue agent with motivations entirely unrelated to, and contrary to the benefit of, the program/university who employed him.
Sure, a defense can and will be made, but I don't see a way we skate on this untouched.

He'll come out of it smelling like roses again. It'll get passed off on an assistant who gets fired and that he "had no knowledge".

They weren't in wrong place at wrong time. They were sloppy and more blatant than the others. This isn't an NCAA investigation. This is the FBI. That's not wrong place at wrong time. That's wrong place at wrong time doing the wrong thing for a long time. I'm sure more will be named, too.

Somewhat, but not really I'd argue. All benefits to players can ultimately blowback on a school, and therefore can be contrary to the interests of the school. But motivations are usually at least tangentially tied to the school, as in, to the school getting the player to come or stay there, or more often, just to appease or impress recruits or players. That represents what, the huge majority of improper benefits matters?
That is not the case here, at least from what we know. So while I agree that I'm far from certain we get out of this without NCAA trouble, I think the argument we're talking about has far more plausibility and importance in this situation, at least based on the limited facts so far.
