It's inadmissiable in a court of law. Last time I checked, the NCAA isn't a court of law.

All the idiots in the media talking about what the NCAA can "prove" are talking out of their asses.
There is no burden of proof. There are no rules of evidence.
The NCAA will review whatever they can gather, and make whatever determination they want.
If they're convinced he accepted cash, he's done. Plain and simple.
They don't have to "prove" anything.

the NCAA suspended an OSU Pitcher for contact with an agent while in high school but lacked sufficient evidence. The Pitcher appealed and had it overturned but only after missing part of the season. He later sued the NCAA for defamation of character and the NCAA settled for $750k. A college pitcher. You probably never even heard that story.
This one is all over the press. So what's the reigning Heisman winner worth? 100X that? The publicity may be a million times more. Neither the NCAA nor Texas A&M is going to punish anyone without sufficient evidence no matter how much you want them to.

Being a lawyer for 20 years I think they were law books but I do try to avoid them when possible.

Can't speak for anyone else, but I truly don't care. Yall don't carry that kind of weight for me. Honestly I'd rather them beat Bama.
We shut down JM last year, so we'll be able to hold our own at least.
But A&M is literally the only other game Bama has to worry about, so I'd like to see JM give them a loss, although I don't think it happens with JM or not.

And you would sue them for what? Due process, (see prior post ) some type of discrimination, ( not state actors) his constitution right to play football,(maybe in Texas but no) slander and libel maybe, ( look at pubic figure exception and ny times vs Sullivan first) and truth is a defense and then there is that pesky discovery rule in civil litigation which would allow them to subpoena documents and depose everyone under oath.

The Auburn issue was a totally different deal and the tapes that were discussed and the tapes were FBI tapes of a investigation of a lobbying firm and casino owner that supposedly accidentally got tape conversations concerning the cam newton situation, bobby lowder, etc. almost every lawyer in Montgomery knows about them. What or what is actually on them we may never know almost of the targets either plead out or where acquitted and it looks like the investigation is done.

Big difference is that the "tapes" were figments of someone's imagination. If they had existed, nothing would have kept the bammer lawyers from exposing them.
It was all made up - and a colossal fail.
