The NCAA could suspend him based on these allegations alone. Sorry, but his only recourse would be to sue after the fact.
Like an injunction, they could cut him off pending the completion of the investigation if they wanted to.
Nevermind due process in a criminal court. The NCAA is a private entity and they can do whatever they want.
