Miles doesn’t have to be in the process of committing a crime himself, but accompanying someone who is and if it was his gun, that would make him an accomplice. Initial crime would be firing into an occupied vehicle.

If this is the case, I hope that the DA goes easy on Miles on return for testifying against Buzz.
