He obviously chose to shut the frick up (as well he should) and let the cops investigate without his input, beyond telling them of an audio recording that would provide proof of him not being the primary aggressor. His refusal to provide the audio recording (should it exist) further shows his intent to not participate in the police investigation.

The police are trying to lock you into a story, and just after an adrenaline filled event is not always the best time to offer testimony.

Guilty or not, Beard made some wise choices AFTER the police were called. I'm not familiar with Texas law but, in a lot of jurisdictions, the decision to arrest is out of the responding officers hands, as the arrest is mandated, by law, should signs of physical contact be presented.

He was going to jail, either way. No need to aid the prosecution without consulting legal council.

Guilty or not, this is how police interactions need to go down. They are not there to issue justice. They are there to arrest someone, more often than not.
