It would be nice if the reporters who have clearly seen the probable cause statement would just post it instead of reporting bits and pieces of it. Would likely answer a lot of questions. I'm not sure how TX works, but TBI in Tennessee takes FOREVER to analyze blood samples for DUI stops. They're always at the very bottom of the pile. I had a kid where we had to wait for almost 6 months to get that report back. Thank god all he had in his system was synthetic weed that didn't show up because his field sobriety test was BAAAAAAD Like could barely walk and talk bad.

I don't know what the turnaround time for that stuff. I haven't stepped foot in a criminal court in over a decade at this point. And I have to assume that if the reporter saw mention of marijuana suspicion, they would have mentioned it. But that's a big assumption with small town local journos, I guess.
Also, is that synthetic weed stuff still around?
I remember when it first came out (or got popular) in the early 2000s, and it fricked people up bad. WAY worse than weed.
Even the people I knew who were open to dabbling in less than legal intoxicants wouldn't touch it.

Having a gun in your possession while also possessing a scheduled narcotic is a federal crime. Aggie better pray that the US Atty isn’t a Texas graduate.

No idea, this was around 8 or so years ago. They do have other alternatives that I've seen have crazy effects on some people. My client's husband was just indicted for multiple counts of rape of a co-worker, having drugged her with Delta 8

So how can you book a guy for DWI when he blows under the legal limit? Is that just one part of the criteria. Can you still be booked if the arresting officer thinks you failed the eyeball test?
There are ways to pass a breath test. Am sure he was given a blood test which will tell the true story

Well if he took 3 zanax with the small amount of alcohol then he was probably still intoxicated. The blood test is all that matters at this point. I just saw on SEC network he has been suspended from the team which is probably standard. It does kinda sound like overzealous police at this point but like I said the blood test is all that matters.

He was under the legal limit and it's not against the law for someone under 21 to possess a handgun in the state of TX.

Unless the guy was clearly falling down and you know really intoxicated, it sounds like bullshite to me. There is no reason to think he had taken zanax or anything.
At a certain point, it's really just harassment rather than keeping people safe.
I have 0 tolerance for DWI and think people should spend time in jail for it minimum. But he blew legal. As far as weed goes, I think it's effects are generally overstated. I mean if you're Cheech and Chong parked in the median stoned it's one thing. But if you smoked part of a joint an hr or so before driving, that's really not a concern.

The field sobriety tests are mostly just an excuse for the cop to do whatever they want. It's a real problem because people are getting pulled over and arrested for this, and it happens to people who don't even smoke weed at all. The cop just says "Oh well I think you exhibit signs of smoking weed, I'm going to arrest you".
And then based on these tests, his rights to privacy/security were taken away. He passed the actual scientific test, but the cop didn't get the result he wanted, so went with plan B - doing whatever the frick he wants.
I mean maybe I'm wrong and the guy was so fricked up he could barely stand, but that doesn't really seem to be the case. And as far as I can tell, they didn't find the weed first, which would give them cause for further testing beyond a breathalyzer, so it's just a fishing expedition that goes well beyond protecting the public.
