I'm surprised they denied him bond. I've seen worse cases where the defendant was given bond.

Tuscaloosa news has an incredibly detailed account of what happened that night based on security footage. Including the path of the Jeep.

Johnson told police he turned around on Grace Street because he wasn’t from around here and was trying to find the best way out. Humphrey testified Johnson never communicated to Humphrey that he didn’t know how to get out of there or that he is not familiar with Tuscaloosa. Johnson never asked Humphrey for directions.

1:45:22 a.m.: Miles walks past the Charger on Grace Street as the Jeep comes closer. Then Miles walks past the Jeep.


There is a pretty damn good case that boyfriend was looking for a fight. But at the same time, Miles and Davis were hanging around the Jeep for a short while before Davis approached.

I think Davis is fricked and rightfully should be. He jogged at the car with a gun after allegedly threatening its passengers 5 minutes prior. Miles’ ruling will be fascinating to see

It’s a shame that miles was charged with capital murder. Our judicial system has some major flaws in it.

By all accounts his buddy was drunk, angry, and had just initiated a confrontation with someone. Then Miles gave a gun to him

Do I think he ever was part of a plan to shoot the people in the Jeep? No. But his self-defense claim isn’t perfect

A fantastic fact for him is that the Jeep had already driven by them AND turned around before retrieving the gun. All with its lights off

I’m not say he’s totally innocent but capital murder means you were complicit with intent to kill. There’s no indication he planned or coordinated a murder.

Not necessarily in Alabama. Shooting into a vehicle, regardless of premeditation, can be considered capital murder. That being said, Miles is definitely over charged in this case.

Yes he still works there. No he hasn't apologized to Brandon. In fact a couple of weeks ago when it came out it was a student manager instead of Kai Spears he quadrupled down and said everyone associated with the basketball team present at the shooting should have been removed from the team. Just for being present. He's a jackass.

Darius Miles seeks immunity hearing in capital murder case. What it means

Darius Miles' attorneys filed a motion Thursday for a pre-trial immunity hearing and motion to dismiss, according to court documents.

Miles, the former Alabama basketball player, was indicted by a grand jury on a capital murder charge alongside Michael Davis in March after a fatal shooting on the Strip on Jan. 15. Investigators said the gun used to kill Jamea Harris belonged to Miles, 21, but that Davis, now 21, pulled the trigger, per court documents. Both have been jailed without bond since Jan. 15.

From the motion: "The Defendant, by and through his attorneys, Mary Turner, Kayla Griffin and Grace Prince, pursuant to Ala. Code § 13A-3-23(d), and hereby respectfully moves the court for a pre-trial evidentiary hearing to determine whether Defendant is immune from criminal prosecution. Defendant additionally requests that at the conclusion of the evidentiary hearing, this case be dismissed, and Defendant be discharged without further obligation of this Court."

A date has not yet been determined for the immunity hearing. Miles has pled not guilty.

In the immunity hearing, Miles' attorneys would have the opportunity to argue in front of a judge that Miles acted in self defense, made possible through Alabama’s stand your ground law. If the attorneys succeed, the judge could dismiss the cases against Miles.

If the judge doesn't make the self-defense ruling, the next step would either be a plea agreement or a jury trial.

Two bond hearings have been held for Miles. Throughout, Turner, has argued Cedric Johnson, the boyfriend of Harris, was the initiator of the incident and that Miles provided the gun to Davis for protection. Davis’ attorney, John Robbins, has argued Davis acted in self-defense. Meanwhile, the state’s position is that Davis shot first.

Robbins has filed for youthful offender status for Davis because Davis was 20 at the time of the shooting. Anyone in the state of Alabama who is under 21 when charged with a crime has a right to apply for youthful offender status. Davis is set for a hearing on July 21 to determine whether he gets youthful offender status. If granted, he would spend no more than three years in a corrections facility with no more than three years probation.

just curious here. but if they were able to use the cameras to follow that jeep all around up and down, then why cant they see who fired first? did they suddenly go into a blind spot? or, did they actually see it and this is why d miles and his friend are in jail? however, as a non lawyer, it doesnt seem like d miles could ask for immunity if that were true. hmm...

I believe both weapons were fired inside the vehicle (Davis reached in, Johnson from the driver’s seat)

The prosecution's case here seems very weak, especially against Miles.

Surely they have more tying him to the scene.

Beyond that, it seems they're just assuming Davis shot first. How can they possibly prove that if it isn't on the video?

I just don’t think that matters for Davis either way. He walked to the car and stuck a gun into the vehicle. The driver, who is a noted piece of shite, is allowed to defend himself in that situation (although the Jeep driving around the area muddies that up)
